Markham C. Erickson
Open Internet Coalition
Markham C. Erickson is Executive Director of the Open Internet Coalition and a founding partner of Holch & Erickson LLP, where he represents clients before regulatory agencies, courts, and the United States Congress. His practice typically involves engagement on complex issues relating to the Internet, new technologies, and nascent industries. He also has an active practice in Native American law and policy.
Mr. Erickson helped to write and negotiate many of the federal laws that govern e-commerce, technology, and the use of the Internet, including the CAN-SPAM Act, the Children's Online Privacy Protection Act, the Digital Millennium Copyright Act, and the Communications Decency Act. In addition, Mr. Erickson represented the United States before the Organization for Economic Cooperation and Development (OECD) on matters relating to speech and content regulation on the Internet.
He serves as lead counsel to leading Internet companies in the Open Internet Coalition, a coalition representing consumers, grassroots organizations, and Internet companies advocating for "net neutrality" before the Federal Communications Commission, the Federal Trade Commission, and the United States Congress.
He also serves as Executive Director to NetCoalition, a coalition of Internet companies that include eBay, Yahoo!, Amazon, Google, IAC, Wikipedia, and Bloomberg LP. This work involves coordinating efforts to promote a healthy legal environment for Internet business models before courts, administrative agencies, and the United States Congress.
In addition, Mr. Erickson routinely represents start-up companies and technology firms on matters before the Department of Justice, the Federal Trade Commission, the Federal Communications Commission, and the United States Congress. He has written extensively on issues relating to law and technology. His most recent article, "Carcieri v. Salazar: The Supreme Court's Definition of 'Now' Creates Uncertainty for Indian Tribes", is scheduled to appear in the summer of 2009 in The Federal Lawyer.
